Zaytech – Marketing Terms & Conditions
We’re constantly developing new technologies and features to improve our services. For example, we are utilizing QR codes and social media strategies to help bring more awareness to your Online Ordering.
As with any business, your results may vary and will be based on your individual capacity, business experience, expertise, level of desire, time invested, etc. There are no guarantees concerning the level of success you may experience. The testimonials and examples used are exceptional results, which do not apply to the average user and are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual’s success depends on his or her background, dedication, desire, and motivation.
There is no assurance that examples of past earnings can be duplicated in the future. We can not guarantee your future results and/or success. There are some unknown risks in business and on the internet that we can not foresee, reducing impacts.
We may request your participation to send us videos and pictures to provide great content on social media. We may also post on our Social Media the services you offer to bring additional awareness and promote your business. Zaytech shall not be liable for a certain volume of traffic, a number of clicks, likes, follows, registrations, purchases, or the like.
All Social Media Packages (Gold, Silver, Bronze) are provided on a monthly subscription basis. The Client acknowledges that Zaytech will automatically renew subscriptions at the end of each term to avoid any interruption to service. Services will continue to be provided until the existing service subscription has been provided in full to the Client (i.e., until the end of the month for which the services have already been invoiced or been pre-paid). Social Media Packages are currently offered at a month-to-month term or a minimum three-month term – the right to terminate services only comes into effect once the term has been completed. Late payments shall be considered constituting a material breach of the subscription entitling Zaytech (at its discretion) to cancel the subscription. In the event of a late payment, Zaytech will inform the Client via email or phone call about the incident. The Client has five business days from being notified to reply, and if no communication has been received, Zaytech will cancel their subscription.
Monthly meetings to discuss analytics and future postings must be scheduled a month in advance for holidays, specials, or events. Zaytach cannot guarantee any last-minute changes. If the Client places demands on the time and resources of Zaytech that fall outside the agreed package, Zaytech shall charge a fee for the time of any Social Media employee for the fulfillment of all such requests, plus any additional expenses incurred in the completion of such requests.
If you are not part of our Silver or Gold package, there are no revisions or extra posts. Any additional revisions or extra posts will incur an extra fee. Prices for the fees are subject to change.
Zaytech reserves the right to modify or discontinue, temporarily or permanently, their services with or without notice to the Client. Zaytech shall not be liable to the Client or any third party for any modification to or discontinuance of their services save for the return of any prepaid sums in connection with the provision of their services which are subsequently not provided.
The failure of either party to enforce or to exercise at any time or for any period of time any right pursuant to these Terms does not constitute, and shall not be construed as, a waiver of such terms or rights and shall in no way affect that party’s right later to enforce or to exercise it.
If any term of these Terms is found illegal, invalid, or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining Terms, be deemed omitted from these Terms and shall in no way affect the legality, validity, or enforceability of the remaining Terms which shall continue in full force and effect and be binding on the parties to the Contract.
Zaytech may from time to time make any valid alteration to or variation of these Terms by publishing the revised Terms on its website and informing the Client by electronic mail that the Terms have been modified. Continued use of the services constitutes acceptance of the revised Terms by the Client.
